Miami Pedestrian Accident Lawyer

pedestrian-accidentsSouth Florida’s population is growing significantly resulting in an increase of pedestrian traffic. Negligent drivers, reckless drivers and drivers under the influence pose a great threat to pedestrians.

Florida law provides that a pedestrian shall obey all traffic control devices specifically applicable to the pedestrian unless otherwise directed by a police officer. This applies to all traffic control signals at intersections. A pedestrian must use sidewalks where provided, and shall not walk along and upon the portion of a roadway paved for vehicular traffic. In circumstances where there is not a sidewalk, the pedestrian must walk only on the shoulder of the roadway on the left side of the roadway, facing traffic, which may approach from the opposite direction.

The driver of a motor vehicle at an intersection/crosswalk that has a traffic control signal in place shall stop before entering the crosswalk and remain stopped to allow the pedestrian, with a permitted signal, to cross the roadway/crosswalk when the pedestrian is in the crosswalk.

A pedestrian crossing a roadway at any point other than within a marked crosswalk shall yield the right-of-way to all vehicles upon the roadway.

If you or someone you care about was recently involved in a pedestrian accident, it is very important that a thorough investigation of the accident and all facts surrounding it be conducted as soon as possible. If not, the evidence can be lost and/or destroyed. Having evidence and legal representation can make all the difference in your ability to receive fair and adequate compensation for your damages.

How can a South Florida Pedestrian Lawyer help you?

The Perez-Gurri Law Firm will handle all aspects of your case, from filing the claim with the appropriate insurance companies to managing the collection and payment of all medical bills. The law that applies to pedestrian accidents is unique. We will explain the law to you and how it affects your case.

Unfortunately, in many instances the accident will result in catastrophic injuries to the pedestrian.

What to do after a Pedestrian Accident:

  1. Report accident to the police
  2. Take photographs of all vehicles involved
  3. Take photographs of all visible injuries
  4. Obtain the name and phone number of all witnesses
  5. Obtain immediate medical attention
  6. Do not speak to anyone but your attorney

You should consult with an attorney who can advise you of your rights and the potential value of your damages. Like in automobile accidents, it is very likely that an insurance company adjuster or investigator will attempt to contact you and obtain your statement before you have had an opportunity to speak with an attorney. It is always recommended that you speak to a lawyer before you speak with a representative from an insurance company.

What you may be entitled to receive, including but not limited to:

  • Payment of medical bills
  • Payment of lost wages
  • Payment of lost services
  • Payment for loss of earning capacity
  • Payment for physical pain and suffering
