Pedestrian Accident Perez Gurri Law

South Florida’s population is growing significantly resulting in an increase of pedestrian traffic. Negligent drivers, reckless drivers and drivers under the influence pose a great threat to pedestrians.

Florida law provides that a pedestrian shall obey all traffic control devices specifically applicable to the pedestrian unless otherwise directed by a police officer. This applies to all traffic control signals at intersections. A pedestrian must use sidewalks where provided, and shall not walk along and upon the portion of a roadway paved for vehicular traffic. In circumstances where there is not a sidewalk, the pedestrian must walk only on the shoulder of the roadway on the left side of the roadway, facing traffic, which may approach from the opposite direction.

The driver of a motor vehicle at an intersection/crosswalk that has a traffic control signal in place shall stop before entering the crosswalk and remain stopped to allow the pedestrian, with a permitted signal, to cross the roadway/crosswalk when the pedestrian is in the crosswalk.

A pedestrian crossing a roadway at any point other than within a marked crosswalk shall yield the right-of-way to all vehicles upon the roadway.

If you or someone you care about was recently involved in a pedestrian accident, it is very important that a thorough investigation of the accident and all the facts surrounding it be conducted as soon as possible. If not, the evidence can be lost and/or destroyed. Having evidence and legal representation can make all the difference in your ability to receive fair and adequate compensation for your damages.
